TN and B2 extension questions

My husband's TN is expiring in a couple of months. We will be mailing in an extension, but if it is denied, do we have 10 days after denial to send in the i-539? I know that while your TN renewal is pending you can continue to reside in the US and can continue working.

We own a house in Canada, and are legally required to give our tenants a certain amount of time to find a new place, as well as wrapping up our affairs here in the US.

I'm assuming that he cannot work while we wait to hear back on the extension, correct?

Thanks :)

Why cant he find work? I am assuming the skill sets that brought him here on TN can still be made of use with another company....right?

I just got laid off too (mortgage industry woes), but I am already looking since I know my skills are transferable. I also had an interview with a headhunter this past week, and they told me NOT to de-camp until early April, when my real termination date comes.

I also have a condo and might have to consider renting it out (or selling) if we return to Canada...I suggest you consider the same.

TN renewal's denial is very rare...since he will be using the same paperwork that got him into US in the first place. That being said, if it is denied, u can immediately file for B2, and stay in the US for 6 months, while wrapping up your business
