TN-1 with 797A travelling to Asia for the first time.

Hi all, I apologize for asking a similar question that has been asked before. However, I consulted a lawyer from Lawfully this weekend who told me a complete different answer for my question. So I am posting to ask for your help!

I have only ever travelled with my TN-1 (Canada) visa stamp in the passport. Last year, my company filed an extension of status for me that expires in 2025, so instead of the stamp, I have the 797A. This will be my first time leaving the US since obtaining the 797A.

I am travelling to Asia for two weeks. I thought all I need is my passport, 797A which has my I-94 on it, and my healthcare worker visa screen. However, I was told by a Lawfully lawyer that when I re-enter I will have to re-apply for a new TN-1 at the border, including interview, application fee, and a new application package. From what I understand, my TN visa should allow multi-entry and no new application necessary. I am confused and am hoping for your advise regarding documents/procedures for re-entering the USA. Thanks so much!


P.s. I will be bringing the application package from last year plus the employment verification letter just in case. I just want to know what are the essential documents and what others experience are travelling out of North America. TIA!
 
You should bring your application package and proof you are still working , but there will not be any "reapplying" for your TN. They will likely review the paperwork, and *may* issue you a new I-94. You don't have a "visa", you have TN status. There shouldn't be any fee for this.
 
Thanks so much for your detailed reply! It is so helpful! When you say *may* does that mean that they might not give me a i-94 and admit me? I know there is always a chance the CBP decided on re-adjudicating... But I am hoping with I-797A I will most likely be able to come back.

Some officers prefer issuing a new I-94 whenever one enters the country, especially from overseas. It does not mean that your TN is not valid, or even that it is scrutinized. Just don't be alarmed if they take your old I-94s and reissue one.
