Tips for Interim EAD

When I thought that nothing else can go wrong, the whole world seems to be falling apart.

My EAD expired today as I haven't heard anything on my renewal application with a receipt date of March 8th. My company took me off of the client site and basically told me to wait till June 8th and then go apply for the interim card.

I can't wait that long without a pay, moreover, without working! Hence I have decided to go to the local office in a couple of days and request an interim card.

I spoke to a very well renowned lawyer friend of mine and he suggests the following documents:

1. A letter from the company stating that they have laid me off because of expired EAD but will rehire as soon as the new EAD is issued. I have my concerns about this as I don't know what, if any, could be the impact on my pending I-485 application. I have asked my company to issue a letter stating that I have been released on an unpaid leave of absence and will be reinstated as soon as the EAD is approved.
2. Labor Certification copy
3. I-140 approval
4. EAD filing and receipts
5. Prior EAD cards
6. I-485 receipt

Do I need to get anymore documents that you all can think of? What can I say to the immigration officer that can melt their heart to give me the interim card prior to 90 days of filing? Can I mention that they jacked me out of 2 months of EAD validity when they renewed my card last time?

I did fax an expedite request to the Director of TSC for I-485 about 3 weeks ago. I spoke with and then sent a case history letter to my congressman's office. This afternoon, I also sent an expedite request to the Director of TSC for the EAD filing explicitly noting today's expiration date.

I would appreciate any inputs.
 
couple of things

you applied too late. I wouldnot talk or give in writing you are laid off etc. take an appointment and go with ur 485 and other documents. i think currently they are processing dates after march 8th and say you want an interim id... maybe it will work best of luck :rolleyes:

My suggestion to contact the congressman office, don't say them you are laid off but you are not in payroll because your ead is expired and draw some attention form the congressman people and have them to talk to the local ins for interim ,and they may able to get a appt. from the local office so that you would be confirmed that they are not going to turn down your request as it's not 90 days yet.

Which local office are you with? Go to NC and they will give you before 90 days. hey have done that for couple of guys who posted here. Explain the situation. They were not from NC, NC knew about it, NC also knew 90 days had not passed, yet they could get iEAD valid for 8 months.

I suggest go there today with all documents. You will need to wait in Q but by this tomorrow, you will walk out with EAD and a smile on your face.
 
My EAD will expire in 20 days. In 2 weekd, if I do not get renewal, I am planning to go to local office first then go to NC.

In your case, I would definitely try NC option rather than being not paid and loose money.
