Hey all,
my sister received her permanent GC on 07/2005 based on her 7 year marriage. Unfortunately, they divorced this year. The question is: when can she apply for a citizenship? I am getting different opinions from lawyers on that question, some say that she is subject to 5 year wait, other say 3?
Does anyone know an answer to that? Thanks!

The 3 years apply if the person is still married with the same USC and has been a LPR for 3 years plus the other requirements...since she is divorced, then she must wait 5 years.

Check out the citizenship requirements at uscis.gov

If she is still married to the same USC she got her GC from... she is eligible to apply 2 years 9 months after her GC was approved (also provided she meets the continuous and physical presence requirement). If not, then she is eligible to apply after 5 years from the date she got her GC (she must still meet the continuous and physical presence requirement).

Based on what you wrote, she has to wait till 2010 and comply with the presence requirement in order to be eligible to apply for naturalization.
