Are you a GC holder or a USC?

question on filing i-130 for spouse of US citizen.

Hi there,

For a US citizen's wife and she is a Canadian citizen currently in the US. What form to file for getting her a Permanant resident. I know first I-130 is needed, is there any other form that can be filed with it such as I-485 and EAD application? I think for canadian citizen the visa number is not needed. Please share the filing forms and procedures if you have experienced similar situation or have knowledge on this. Thanks in Advance.

The entire timeline depends on how quickly different steps are completed with NVC and which consulate you will go for final interview.

Here are a couple of threads for recent CP timelines

Which service center did you file your I-130 with? How long did it take for approval?

Jattpunjabi,

Is your wife in the U.S. in a status of any sort? If so I was told by my attorney to not fill the NVC forms and that I should be able to file an I-485 for an AOS. I am a Canadian married to a USC, but since I am on an H1B I went ahead and filed all the forms (I-485, I-1765, etc). My attorney told me to hold onto whatever I receive from the NVC and once I get my GC to simply write them a letter indicating that I have received Permanent Residency. Hope that helps.
