Hello,

My labor processing from Micigan will get over by Jan 2004. After that if I file for consular processing, how much time will it take for interview at Mumbai consulate?

Do you think my US lawyer can prepare paperwork for consular processing? or am I on my own?

And yes, how risky it is? Consider that I have a clean F-1 to H-1 journey and working with same employer.

It normally takes 6 to 9 months for the regualr CP process from
the date of I-140 approval to the Interview date.

However with the Mumbai consulate you have the option of
going for the AC140 ( Attorney Certified I-140) which basically
eliminates the National Visa Center and deals direct with the
Consulate. This can cut down the time by about 40 days.

For AC 140 you NEED an attorney.

For the regular process it will be your option to either have an
attorney or do all the work yourself.

For CP the only requirement would be, you should be holding the
job till the completion of the process. Other than that travel to
the consulate and so on are involved.

With a clean record and if you are willing to travel CP is a good
option.

Just a sub-question:

You said that in CP it is essential to continue job with the same employer. Then in case of regular I-485 (within US) processing one can change jobs? Last I heard was that under the AC-21 Act, one can switch jobs after 6 months of I-485 filing to a "similar" job (a tricky interpreation issue)?

The protection ( flexibility) of AC 21 is not available for the CP
route. To get into the 485 route you would file the I-140 and
485 at the same time ( concurrent).

Once you are in the 485 line, under the AC 21 act ,you can change
the employer after 180 days from the date of filing.
