Time for which one must be with the sponsoring company

Mine is a standard CP case under EB3 category and my sponsoring company has offices in India and US. I worked earlier for the US branch but now am working for India office. now my company is finding difficult to find me an assignment in the US.

My question is, once I go for the interview and Immigrant visa is granted, for how much time I MUST work for the sponsoring company? or there is no such condition?

The whole GC rests on the premise that you are going to work
for the sponsoring employer permanently. At the time of going
for the interview you shoud have the intent to join them and
work for them

However it is also a fact that this theory does not work all the
time. You will not find any one officially saying that a certain
time period is sufficient.

But general feeling is, a minimum period of 6 months with the
sponsor would establish your intent. However if the employer
lays you off before that period, it is OK.

While going for the interview, I will have the notorised employement letter and the intentions is 100% to work for my sponsoring company. But , when I enter US will it be a problem if on the context that there is no feasble project/assignment, I resign from the sponsoring company within a month or alternatively my sponsoring company terminates me on the above basis?

Does the INS or any other agency have an objection me joining some other firm with the same kind of job description after I enter US?
 
There should not be any immediate problem but It may affect in future when you apply for US Citizenship or apply for re-entry permits etc.

However, it would be better if the employer lays off you rather than you resign on your own. This may support you - 'you want to continue with the same employer , but the employer has fired you'.

As raju, suggested, people don't take risk and they don't leave the sponsoring company within 6 months.

I don't think INS/other agency will have any objection.

CPZinga, Raju...what could be the affect? I am very much concerned as I guess that may happen to me....

when will i apply for re-entry permits? I hope that once I enter POE and I wait till I physically receive my plastic card...I will not require any visa to enter/exit US....i hope i am right?

any inputs from other guys....

I think there are 2 aspects here.

If you stay out of US for long, then your re-entry permit might get affected. If and when you apply for citizenship (say 5 yrs. from now and the same rules apply as today), the fact that you willingly left the co. on your own withing a month of getting you GC might raise flags
 
so if I get fired withing 15 days-1 month after landing in the US...there will not be any problem for citizenship? or atleast there will be less problem?


Has this kind of scenario happened with any body? I am sure in this weak economy, there must be some people who may have come through this situation...if yes.. may I request them to share there experiences ....

As getting fired immediately after receiving employment based GC is a typical case, may be I will open a new thread and all can share their views
