Time for Advance Parole?

HI,

I applied AP for my wife last week and she need to go India urgently by march first week. Is it possible that her AP can be approved by that time. If not can she travel without AP and when it gets approved I will mail to India,and she can come back using that AP.

Did any one applied for AP in last month? please share the information about the time it is taking now to process AP.

If she doesn't have any other valid visa or any other previously unexpired advance parole, then she must NOT leave the country before her AP gets approved. I have had first-hand experience of both scenarios -- one was good in which my friend and his wife took the bold step and entered into the US after their approved copies of AP were sent by FedEx to India and they had no problem; whereas in another case the USCIS was able to detect that my friend had left the country before approval of his then visa petition and promptly denied the case for abandonment. So, you make the call.

In any case, even if USCIS doesn't detect that your wife has left the country before her AP approval, such a detection is still possible by the officer at the port of entry when she comes in to the country. Usually, the very first time you use any AP, you will be undergoing secondary inspection where the officers will ask a few questions, take copies of your passport and have a copy of AP for themselves.

It is really a question of risk and it is one of those scenarios where you cannot be a dare-devil maverick :) . You might need to evaluate before taking the risk.

If you have documents that proove the emergency for travel, you can show them at local USCIS office and get Emergency Advance Parole which will be valid for like 3 months (This depends on the officer's decision). You may have to pay the AP fee again!! I tried this route and I got Advance Parole.

If you can talk to an Immigration Officer in Local Office of USCIS, and proove the urgency, I heard, they can expedite the process of issuing the AP or provide some interim document, in anticipation of the AP that is in Process.

Advance Parole

Please share if any one received Advance payrole after jan .I have a notice date of Feb 06 and I urgently want to travel India as my mother is ill.I went to local office also , they say, they will email main center to expedite it, but nothing has happened so far.What other options do I have.

Contact your local congressman, he may be able help you. Write a detail letter explaining the situation and fax it with supporting document to him/her.

Also check your inbox, I sent some additional information.
 
AP Delay

I applied for AP for my husband in November '05 and we have not gotten it yet. We had an LUD with approval and then an REF for extra photos. I don't understand what's taking so long.

we applied on feb 8 and LUD was on 2/19 and 2/23 , I don't understand what is happening. I did filed online this time.

Even there is a LUD on all my cases (AP + I485) on 02/21/2006.Look like these LUD does not mean anything.
