Time difference in Concurrent Filing

Can i file I140 today and I485 after 1 month (i mean before my i140 gets approved). Is this a valid scenario of concurrent filing??

You can file both I140 and I485 at a time.

(or)

You can file I485 with I140 receipt notice.

if you do not file both once then you need to wait until u receive I140 receipt notice, usually it takes 2 to 3 weeks.
 
file 140 and 485 together if possible

if you think that you can file 485 in a month, that is get all the documentaion ready in a month of filing the 140, I would suggest that you file them together. THe main reason is that the INS has become real irregular in sending the receipts. I have not received the 140 receinved till now...its been two months since I filed. Ironically, the INS cashed my check.

Similrly, if you go though the discussions ( also on 485 issues), you can see that it is not me alone. There are lots of people. I am saying that there is good probability of you not receiving a receipt in a month.
I am not trying to discurage, but htis is something to consider.

On the other hand, since 485 documention could long time if you do not try to speed things up and you need medical test and repot, if you think it can take more time like two months to file 485, you can go ahead and file 140 now. Two months (or more) seems a long time.

BTW, my lawyer told me that it is kind of typical of VSC not to send recepits. It may not happen to every other case but it happens to a lot of cases (not one or two).

Concurrent filing not mandatory

I filed my I-140 at NSC on 11/7. Got LIN# within two weeks. Prepared all paperwork and filed my EAD, AOS and AP on 1/4/03. I got RFE for my I-140 on 1/7. It took 10 days for my lawyer to get the exact details of the RFE which he is still mulling over. He hasn't shared the details with me or my employer yet.

Hope this helps. Moral of the story = 'You can file I-140 and I-485 separately or one week apart or whatever'
