time between visits on B1/B2

I have already asked this question on the forum, but my plans are clearer now, so i will appreciate it if somebody helps me to figure this out.

here is my travel schedule:

I was in the US with B2 multiple entry visa during the May 12, 2010 - October 5, 2010 (4 months 24 days)

My visa as well as I-94 expire on November 12, 2010 and i am gonna apply for visa again this December for the 4 week visit in January 2011. So time interval between those two visits is gonna be like 2 months and 20 days.

I just wonna know can they refuse me at the embassy because of

1. i stayed in the US almost 5 months?
2. the interval between visits is just 2 months and 20 days?

Just quickly i have been to US in 2009 couple of times for short periods, never overstayed and i can provide all the necessary documents, invitations etc about my 5 months stay and upcoming 4 week stay in January.

I'm sorry to be the bearer of bad news but with this history they are more inclined to assume that you come to US to stimulate your economy and are not a genuine Tourist/Visitor unless you prove otherwise.
The chances for a future B1/B2 for you are slim and it will be hard to prove that you will be visiting for 4 weeks in January when the travel history suggests otherwise.

i can prove them how much money i spent in the US, all my invitations and what i did there so proving that i injected lets say 10.000 dollars in their economy isnt a problem and it is true.

i am a doctor from eastern europe

Being financially well off always helps but it never guarantees entry into the US as a visitor. Keep that in mind.

I do not believe that invitation letters provide anything for an applicant. Steady employment and sound fiscal status do help. Do not over think this one. Just apply for a B-2 visa and try your luck out. Best of luck!!!

Exactly what it means. You are applying for a privilege, not a right. Just supply whatever documents you think will convince the consul that you will not stay back in the US, make an appointment and then let lady luck do the rest.

triple citizen, what you think is the best POE in case if they give me a visa in the consulate?

There is no answer to this question. As simple as that. It depends on the individual POE officer. His/her mood. His/her questions and how you answer them. His/her interpretation of your answers. So on and so forth. For what it is worth, in my personal experience, the best airport POE is the US pre-clearance facility at Toronto's Pearson airport. I have used it for 13 years and never had an issue or an unpleasant episode. Now keep in mind, I have used that airport in the following 5 capacities:-

(1) A Pakistani citizen with permanent resident status in Canada
(2) A Canadian citizen residing in Canada
(3) A Canadian citizen with a pending AOS application in the US
(4) A Canadian citizen with permanent resident status in the US
(5) A US citizen residing in the US

Neither of these capacities apply to you, so you mileage WILL vary.

thanks, the reason i am asking this question is that everybody keeps telling you that the NY JFK is the best one and the chicago O'Hare is the worst one. anyway thanks again triple citizen.

as i said my visa experies on Novemeber 12, but i will be applying for 3-4 weeks in janaury, now do i need to wait untill november 12 for my visa to expire or i can go to the embassy before november 12?

Yes, you may apply for a fresh visa a month or two before the older visa expires.
