Finally God's grace on me....Thank you thank you...
Thanks to my wife's prayers....thanks to all well-wishers...


My case details in a nut shell...(dates in my signature)

1. AC21. Changed employer after I140 approval & >180 days.
2. Send AC21 letter to USCIS by myself (saved $1500 which the attorney had asked...i am going to buy a big screen TV with that.. :D :p :D )
3. Changed address twice - had sent address change letters each time.
4. 3rd EAD and Wife's case not approved yet.



What a way to start a day....what a way to start a week....what a way to start a month....
phewwww......i am so relieved and happy... :)


Thanks to all of you...thanks to this wonderful site. And from the bottom of my heart, I wish all the 2001 & 2002 filers get their approvals soon. Good luck to the 2003/2004 filers too.

One quick question. Did you send some sort of letter when you moved from first company to second informing USCIS that on onwards lawyer B is going to handle yu case. I mean who was your lawter when you changed yu first compnay ??

Nope. never changed the lawyer. My application still might have the lawyer's name from my previous employer.
I contacted another lawyer to probe the option of filing AC21...but didnt proceed bcoz of the huge fee.
 
Hey pv1976,

Can you please post sample/template of the AC21 letter that you sent to BCIS? My case is also very similar to yours, I also don't feel like paying huge fee to lawyer for sending AC21 letter to BCIS.

Subject: I-485 under AC21 for xxx
Reference: I-485 Receipt # , A#

Dear Sir or Madam:

This is in regards to the I-485 application for Adjustment of Status, filed at your center on my behalf.

This letter is to inform your office that I, xxxx have changed jobs as provided under the AC-21 law. I hereby confirm that am currently employed with <xyz corp/address) as a <job title> with similar job duties as specified by my previous employer, <abc corp>. The details of salary and job duties of my current employment, as well as a letter from my current employer are enclosed herewith.

My Labor Certification and I-140 were sponsored by <abc corp> and were approved on <dates>. Thereafter I had filed for Adjustment of Status (I-485), which has a Receipt Date of <date>.

On <date>, well after my I-485 application had been pending for over 180 days and the underlying I-140 approval, I began lawful employment with xyz corp, pursuant to the Employment Authorization Document (EAD) issued on my behalf in conjunction with my I-485 application.

According to the provisions of the American Competitiveness of 21st century signed as law on October 17, 2000, and subsequent memo dated June 29, 2001 on the American competitiveness in the Twenty First Century Act and related legislation, from the Office of the Executive Associate commissioner of Legacy INS, change of employment is permitted in cases of lengthy adjustment adjudication. The AC-21 memo allows for a change of employer if the I-485 application has been pending for more than 180 days, and the underlying I-140 petition has been approved and the new job is in the same or similar occupational classification.

Pursuant to the guidelines of the law and memo cited above, and my eligibility based on the fact that my I-485 application has been pending non-adjudicated for more than 180 days and the new job is in the same occupational classification, I request that USCIS continue processing my I485 application and adjudicate favorably. I would be glad to provide any additional information if required by your office.

To NJCGC : I dont think there is any timeframe for filing AC21. I send the letter after around 9 months of switching the employer.
