I talked to my attorney and he is going to call the officer who is working on the case just to ask him Why he needs all the information

If you look on your RFE, there is a code for the officer working on the case. Its right above the signature for Evelyn Upchurch, Something like NSC/KZH XXXX...Thats the officer who is working on your case and he/she can be reached by any attorney.
 
WOW! This is great news. Things really have changed in the last 2-3 years. I guess CIS is taking things a bit more seriously. Its just 'shocking' to believe we can actually talk to someone about our cases - imagine that?!

Look at me...I sound so sarcastic - and I wonder why? :p

What is the point of calling the officer in your case? It is now standard practice to ask for I-602 and evidence of past travel history if you entered the USA in an irregular manner. And they rubber stamp the waiver approvals. Why call and possibly upset the officer? I would do the work and file the waiver request. The sooner you file the sooner you will receive the approval email. :)

Thankful you are right and I agree with you. I told my lawyers just file it who cares...But the officer who has looked at my case is a SOB according to my lawyer and he always gives troubles...So he will prepare the RFE response but also want to make sure that the officer will not ask for anything else later on..which can happen.

A real "SOB" officer could have given you a heck more trouble--like sending you a detailed questionaire about your continued fear of persecution. I think for people who used a fraudulent passport the officer has no choice but to ask for a waiver. Using a false passport (especially a false US passport) is a very very serious matter. And since you has been traveling so widely, it is incumbent upon the INS to figure out where you went and why. So I think this RFE is very reasonable.

Wantgc, out of 5 cases, I received 3 cards that included mine too. I rcvd an E-mail yesterday for my 2nd child (14 years old) that they have mailed a notice for additional evidence. The 3rd child's case (13 years old) is still in pending after the BIOs. Do you have any idea what could they want?? Is it possible for you to ask your lawyer?

Free, I will ask my lawyer on Tuesday but from what I think..Its probably updated vaccinations since they are under 18. If you have already sent those..it may be just a little things..so don't worry...Nothing like they have to fill a I-602 waiver....

Thanks Wantgc, yes I already submitted the medicals and also the bios, thats why I was wondering as to what else they would require? Thanks again.

Maybe his/her birth certificate does not have the names of both parents or something similar.

Did the child do the BIOs?

Yes, the 14 year old had the bios plus full 2 hands finger printing. the younger had just the bios. the ins employee said that when the 2nd child becomes 14 years then she will have to get her finger prints done,but she will get the GC now. Thats what the staff at the center told me at the time of Bios.

I strongly strongly suggest that you file your response without delay. They are approving cases at a furious pace, no doubt trying to clear as many as they can before the fiscal year ends on September 30 to comply with the terms of the settlement. Who knows how their priorities would change after October 1. I would not want my file to arrive after the end of this fiscal year.

Thank you for your suggestion. I have everything ready but I want to make sure my lawyer looks at before I file anything..And I will do that Tuesday. Per my lawyer since the quota was lifted, there is no more FY in processing cases...Asylee Adjustments are just like employment adjustments and other cases that are in queue now..but with the lawsuit they do have more priority...However with backlog reduction, every case is being looked at the same way..... In spite of all that, My goal is for USCIS to get my response by Sep 9th....One week after the RFE.

But they promised the court that they would process a certain number of files by the end of this month. I am sure they will want to report as high as number as possible to the trial judge. I agree with the previous poster that the next few weeks are going to be fertile for asylee adjustment and after October 1 the pace will tame.

True but wasn't the judge promised that in FY 05 there will be 18,000 and in FY 06, there will be 12,500+10,000(22,500). So after Oct 01, there should be more cases processed than FY 05..?

Yes. But my point is that they are probably going to "relax" right after October 1 and assign people to other types of cases. Asylee adjustment is not the only thing they do. They will then come back to asylee cases later. I am sure they will get to you in FY 2005, but it may not the in the early portion of th year. Whereas if you get your stuffs to them quickly they will probably process in this month just so that they can one more case processed. They are now in the mode to process asylee cases.

And knowing that patience is not your virtue :) I would like to think that you want to save a few weeks perhaps a few months.

I'm starting to prepare for the RFE process now. I received the email notification yesterday and waiting calmly for the letter. :confused: Any chance of sending me your attorney's office details. I'm based in CA (South Bay Area). If they don't have an office I'll ask him to recommend an attorney who is familiar with the RFE.

Hayle, Just calm down and see what they want before you jump to conclusions. NO matter what you have to do the work..lawyer will just say yes or no..meaning you have to look for stuff. I will post his contact tommorow after he agrees ..I can't put his telephone number unless he wants me to.

DO not worryo k?..things will be ok ..
