On behalf of my friend I am asking this question:

My LC approved and now I am asking my employer to file I140 and I485 concurrently and he is not ready for that. He said he will file I 140 and later after approval of I140, he will file I 485. Also, he said he will not give copy of I140 receipt to me.

But I want to file I485 ASAP with I140. What are my options? Can I somehow get my I140 receipt from INS?

Some employer sucks and mine is one of them. Please help.
 
Since I-140 belongs to the employer, you cannot get the receipt by calling USCIS or anyother way. Maybe your attorney can get you a receipt?

I think because the employer knows about the 180 day AC21, he wants to make sure your friends doesn't quit as long as possible so that the employer can get away with not giveing raises!!!
 
Maybe you can show your employer some benefits of filing 485 like being eligible to apply for EAD, meaning they won't have to renew your H1 or something. Or you can say that my spouse needs to start working. I have read somewhere that somebody was successfull in get labor cert copy through FOIA. Maybe you can try along those lines.

I suggest that you use FOIA to get copies of LC and I-140 and use that for applying I-485. I think BCIS will be able to locate LC and I-140 applications even if you don't have receipt #. Give it a shot.

I had a similar problem. I began my LC around Jan 2001 and it was approved a few months later. Then my company refused to give me its corporate tax form so that i can file I140/1485/EAD until Dec 2003. I dont know how this would effect the petition since its been so long since the LC was approved. Anyone know?
