This is what I heard from very reliable sources - If you are concurrent filler AND if your I-140/I-485 ND is earlier than the current processing dates AND if your I-140 has not yet approved AND if there is no RFE on I-140 AND if you have completed your FP then you are one lucky fellow, expect you I-140/I-485 anytime next month!!

Nothing yet. My boss sent in a case status referral (inquiry) on April 5, 2004.

I also fit the profile mentioned (although I am in CSC).

WAC03-142xxxxx (EB1C - multinational manager/executive)
RD: April 4, 2003
ND: April 7, 2003
FP: May 20, 2003 (so it's also getting close to expiring)
1st EAD & AP: August 2003
Applied for 2nd EAD & AP: April 15, 2004
140: Waiting
485: Waiting

The current CSC processing date for my 140 category is February 11, 2003 (it's been stuck at this date since December 2003), so theoretically I should be in a good position to get everything done before too long, if there are no RFEs.

I'm hoping the fact that I just refiled for EAD and AP will at least trigger them to look at my 140, and then that might get things rolling... Even if they don't do the 485 at the same time, I'd like the 140 approved for AC21 eligibility.

Of course, I'm not assuming this WILL happen, but I will post if I hear anything else.

I don't think you can fit in this category as your notice date is April 2003 and current processing date is Feb2003.Your notice date should be earlier than the current processing date as 'MZGH' as his ND is May2002 which is earlier than Feb2003.

Let me itemize the conditions for easy reference.

1) You are concurrent filler.
2) Your I-140/I-485 ND is earlier than the current processing dates.
3) Your I-140 has not yet approved.
4) There is no RFE on I-140.
5) You have completed your FP.

It seems lot of folks dont satisfy condition# 3 & 5.

I wonder if the big push at VT to approve the 140s in the past month or so is to avoid the truely concurrent adjudication that they might be required to do after April 30th, just so that they have some breathing room? If that is true, then the people with 140s unapproved after tomorrow could be the 'lucky' ones :D

Except that I don't believe anyone with a ND staring June 2003 has gotten FP notices. :confused:

What do you guys think?

The Ohata memo explicitly states "the local I-140 processing time will control. A concurrently filed I-485 will no longer be tracked based upon the local I-485 processing time"....

..."Concurrently filed I-140 and I-485 will be processed based upon the I-140 receipt date."

Am I Lucky or Unlucky

INS have not toched my case for lat 15 mont ( conC filled with ND Jan 03)
Now today they issued me RFE on I-140
 
FP notices

The last people to receive FP notices were the ones with ND in mid June 2003. Very few with ND after that received FP notices (at least in the last 2 months). The last "big wave" in sending FP notices was 2/27/2004 and after that only sporadic events. The important thing that happened in the last 2 months was lots of approvals for I-140s so (mid July-August now) so as I said in another post there are very few people with I140 not appproved, FP done or notice received who are eligible for the new memo. It might be a trick, I mean USCIS speeded up the process of I140 in the last 2 months to decrease the workload for the new Q generated by the new memo.
