Thinking of getting married

Friends,
I am a US Citizen, and thinking of getting married. There is a high propensity that the girl would be from India, and not someone who currently lives here in the US. What is the best way to bring your wife over to the States? Is it easier to have her stay in India till she gets her GC, and then have her move here, or is it better to get her over here on a fiance visa, and then apply for her immigration from US. What are pros and cons of each approach?

Thanks much, CJ

Well, do you want your future wife to stay in India for months, possibly years until she gets a GC? Get her on a Fiancee visa and then finish the stuff from here.

Do you want her to get Green Card or immigrant visa in India? Once you are married - she becomes your immediate relative - and getting immigrant visa at consulate in India should be fast process. 1, 2 months...

I beleive that consular processing is much, much faster vs. fiancee visa route. In either way the worst case scenario would be third option as someone sugested - bringing her as visitor and then getting married.

K-1 is faster on average than CP route.

Really? Can you share with us what is average time for both routes based on your experience?

By the way – with K1 – she is applying for temporary visa valid for 3 months, and there are certain requirements that need to be satisfied (or visa will not be issued) – which is not the case once you are married.

My K-1 took around 3 months from start to finish in 2002. The only 2 majors conditions are that both parties are free and willing to marry and they have met each other once in the past 2 years.

Thank you for sharing your experience with us. It took you 3 months JUST to get K-1 (fiancée visa)!? How about the rest of process? Getting married in US, filing for conditional green card etc?

If you have married first, and went through consular processing - your spouse would get immigrant visa (GC upon entry to US) within 1-3 months - not just K-1 visa...

Speaking about conditions wasn’t there requirement that USC should spend in spouse native country certain amount of time (I think 1 month) before applying for fiancé visa?

Who told you an immigrant visa takes 1 to 3 months? Consular process averages 12 months.
For a K-1 visa there is no condition for the US citizen to spend time in the fiance's native country.

Who told you that consular processing takes 12 months for USC immediate relatives like spouses and parents?! I can’t imagine that someone can get K-1 visa (fiancée) faster then visa for USC parents and spouses?

I think fiance visa would be a better choice for me. I don't care how long it takes her to get her GC once she gets here. What's important for me is the gap between getting married and her coming to US. If the gap is reduced to 2-3 months as opposed to 12 months, I think that would be a good thing for me.

Now, if the condition about me living in India for 1 month is true, that would (for lack of a better word) 'suck'. However,I don't see anything like that on the USCIS website.

No such condition. Both parties need to meet atleast once in the last 2 years. That country could be the US, the beneficiary's country or any third country. That makes no difference.

Great!!! That's even better that you don't need to have met in a specific country.
