We have just decided to file a petition for me through the the US Embassy here, and my husband has no job as of yesterday!!!!!

So what now???

Questions comes here:

Without any income, does my husband still need to fill out the I-864 form?

His father is the one who needs to fill out to be the actual sponsor now, and we are going to live in his house to begin with.
He has his own business company.

What form does the father need to fill out, the I-864 or the I-864a????
What is he, the actual sponsor or a joint sponsor??
And what is required documents for him as being self-employed?

Also I read something about that the Affidavit of Support is supposed to be signed by the sponsor in the presence of the Consular Officer, does this mean his father needs to come to Sweden to do that???

I'm really confused here...

Please help!

your husband will still be a sponsor, and your father-in-law will be the co-sponsor. Affidavits no longer need to be notarized. Father-in-law will have to produce 1099 and tax transcripts - do read the instructions in the booklet carefully:

A photocopy or an Internal Revenue Service-issued transcript of a photocopy or an Internal Revenue Service-issued transcript of your complete Federal income tax return for your most recent tax year, or an explanation if it is not submitted. Your W-2s and/or 1099 forms may also be required, see the I-864 instructions for details.

Which form needs to be filled out?

Does the father needs to fill out the I-864 or the I-864a "contract between sponsor and household members"?

What is th W2 form?

I'm sorry I ask things I can probably figure out, but I feel a little stressed now.

Your husband, even though he cannot sponsor you because he lost his job unfortunately, will still have to complete Affidavit of Support (I-864). Your father in-law who is his to be joint sponsor must complete one also.

You do not need the I-864A

W-2 are issued in the first month of the year by the employer for wages verification, and tax deductions. W-2 forms are to be used to file taxes.
