TSC is focusing on the cases with 485 receipt dates in 2003 and 2004, as very few outside of those dates have been approved.

Transferred cases have been given second priority but are now getting some action, although not quite as much as we've hoped for.

It will be interesting to see what happens next month when theoretically all of the pending case are eligible to be approved.

All IOs are saying that visa numbers are exhausted. What would they do next month. Since all EB-1,2,3 numbers are current till July 31st. I'm eagerly waiting to see an activity on the cases that are awaiting approval next month.
 
One of our friend filed 485 in VSC in 01/2004. AS they dint get the 2nd finger prints , they went to see the infopass/IO . His cases is transfered just in 06/2007, So they said currently visa numbers were over and come back in october being you PD is on 01/2003.

IO said lot of cases were transfered in March/April and all of them were assgined a visa number. However some of the cases were transfered recently. In some cases they might had allready assigned the visa numbers and you will be requested to take FP after the approval and before getting the GC Card. IO said there is still a chance that you might get the approval
 
I agree - I have seen action on mostly 2003 PD - which is very strange given that there are many cases with earlier PD (2001 and 2002) awaiting action.

But, the point is what's the basis of alloting visa numbers for the transferred cases. I guess they should have allotted numbers to all the < 2004 PD cases across board, i mean without looking if NC is pending or not etc., Because i don't think they can go case by case to validate and allot based on how good the status of the case is?

But on the contrary, if they allotted only to those who appear to have cleared all checks, then that would be a disaster for people whose NC is pending like me, becoz even if NC clears now, we still have to wait till Oct'07 to get Visa number.
 
Omitofo: Jackolantern's theory was TSC is approving based on 2003-2004 RD, not 2003 PD. I have had the same feeling looking at the approvals this week. Looks like TSC is steadily ploughing through 2003 RD cases.

dbwr: Are you saying your friend got a VSC->TSC transfer notice in March 07, but the actual case got tranferred only in June 2007? Or was there no transfer notice till June 2007? It would be very infuriating to find out that people got a notice for transfer, but the case was still in VSC even 3 months after the transfer notice.

It is a balance between processing cases in the order they were received, as well as using up the visa numbers during the time period they are valid for.

I agree it is not fair. In fact, I find the whole concept of waiting for months/years for NC totally bogus. If USCIS/FBI is not able to resolve namecheck within a month, they should just get a complete background check done. Just get the case moving! It's like if they aren't able to clear the name with their automated/electronic process, that's it: the case goes into purgatory, with no established timelines as to when it might come out of there. And the worst part is, you never get to know unless you initiate an enquiry. That is just bullshit.
 
I am thinking how "babyluck" got approval. I saw this post in another thread. I had seen one more with PD 1999/2000 but RD 2005 (VSC - TSC)

So I think earlier PD has also some contributions besides RD of 2003 - 2004.

The Ombudsman's report was questioning the value of the FBI name checks, given that they also run background checks through IBIS and another system. The name checks are supposedly done for national security, but they take so long that they actually hurt national security by allowing terrorists and criminals to remain in the country for years while their case is pending.

I think the USCIS likes the long name checks just because it gives them an excuse to be lazy. If a senior boss asks a manager why his/her team didn't process half the cases assigned to them, they can simply say "they're stuck in name check!" and not be blamed. It's the same reason why they implemented the excessive retrogression in 2005 ... it gives them another excuse to not work on pending cases.
 
They are definitely lazy mfs otherwise they could easily pre-adjudicate all the pending cases with a note like "Cleared for Approval provided name check clears" or "Approved once PD becomes current".

I agree that they are lazy, but some of them aren't . Take my case for instance. I'm still in the NC, but they were proactive on my case. While it was back at VSC they sent me for the second FP and after transferring to TSC issued an RFE for proof of legal status throughout my 14 years here, which is totally ridiculous. ...On the second thought, though, maybe they did it because they were bored out of their minds.
