EORI for I-130 has been with the board for 3 months and there is no time frame. I filed the EOIR 10 months ago. Should I forget about the appeal and file a new I-130 or just keep waitng? It's in the post decision activities status. The base for the denial was that I was three months shy from my 21st birthday. Thank you for reading.
 
Can you clarify if you where the one who filed the I-130 and for what relative (like parent) or did someone file a I-130 for you?

Did you get a notice from the EOIR that your appeal application has been filed with them? Have you tried contacting the case status telephone number (available 24/7) for EOIR at 240-314-1500 or 1-800-898-7180.

IF you are a USC who filed for a parent or sibling before YOU reached 21, the appeal was a wasted effort. It's simple statutory denial.

IF you are the beneficiary, it could have been worth it to preserve the priotity date.
