Guys and Gals,

Mine and my wifes APs have been pending at TSC since JAN 2005. In March a RFE was issued against my wifes 485 and TSC received the reply in early April. Since then there has been no word on our APs or our 485s. I have called and placed numerous inquiries on our APs and I keep getting stupid letters from TSC stating that "The Supervisor has been notified".

Anyway, today my wife managed to get through to an officer at the TSC and the officer looked into her AP file and stated that the case has been closed. CLOSED? WHAT THE HELL? When my wife tried to ask her what that meant the officer didn't know either. She told my wife that she would escalate this to her supervisor. The officer also insisted that a letter was sent to our lawyer on the 2nd of June (there was a LUD change on my wifes AP that day) but my lawyers have not received anything. So at this point I am completely lost as to what has happened and my lawyers are clueless as well.

In Feb the TSC transferred our 2nd EADs to an office in Miami and then we had to force them to get them back to TSC and approve them in Feb. The EADs were probably transferred to Miami because they had tranferred my 485 and 140 to an office in Miami by mistake last year. Some moron must have looked at my online status that still states that the 485 is in Miami and just forwarded the EADs there. Now the APs are stuck in some loop ... I think the TSC is doing everything in their power to screw up my case .. I mean how hard is it to approve a damn EAD and AP.

I am sure very few of you will have any input on this. I just wanted to vent my frustration.

I am not sure on this, but I believe if your EAD (&AP?) are pending over 100 days you are allowed to go directly to the local office and request an emergency AP or EAD. Do you know anything about this?

I am sorry to hear of your tribulations. Success comes to those who persevere against all odds. Surely things will turn around for the better soon for you and your spouse.

Thanks for the encouragement. I believe you are correct on the 100 day (I think its actually 90 days) rule. I am not in need of an AP but the incompetency is very disheartening. I usually keep it together but some days all this gets to me. Hopefully we will all be done soon.

Saras,

I think you should go to the local office eventhough you do not need the AP at this time(just for inquiry purposes, better than those 800 Customer Service) I feel that will let TSC know via local office and the Rip Van Winkle (the Officer who is dealing your case) will wake up from his/her long sleep. i saras, sorry to see you face the heat due to bunch of incompetents. But it is great that, u could get your file back from miami to texas. How did u manage to do aila enquiry? Also how u get to texas officer? To give u some comfort, my 485 RD is Dec 2003 but still nothing has happened, i would be happy to see some LUD on my case

I feel your pain. It's incredible. I beleive you can make infopass app. to speak to an officer at a service center, just like Taslim ahmed suggested. I hope you get some clear answers soon. I don't think the letter they sent on June 2nd it's going to take 20 days to arrive. Please keep us posted!
 
I have to say that F*** TSC. I always think I have to wait patiently. But these donkeys really mess up things.
 
You can only get an interim EAD after 90 days. There is no interim AP. Nor will they grant you an AP on the spot unless you have an emergency. I.e. someone is on their death bed. Even then, you need to have bonifide proof from a doctor that your claim is legitimate before they will grant it.

All you can do is keep bugging them and wait....

I was able to get the file back through AILA inquiries. My lawyer has a AILA liaison who intern has a liaison inside the TSC. I believe only a lawyer can make inquires through AILA liaisons. Somehow they managed to get the file back to TSC. It was not easy and it took almost 6 months. The problem is that my online status still states that the 485 is in Miami. The 140 stated the same till it got approved from TSC, then a RFE was issued from TSC on my wifes 485. All this proves that my case is in TSC now. Unless ofcourse they have lost my 485 altogether. Who knows? I learnt from a lot of people that TSC purposely transferred cases to all sorts of local offices in order to make their backlog numbers look better. There was an audit in October 04 and they wanted to pass the audit with flying colors. They passed it at the expense of a lot of us innocent filers. We are still suffering ..

Regarding getting through to the TSC. Here is what you need to do.

Press 1 (for english),
press 2 (for existing case),
press 6 (for case statues etc),
then press 1( for knowing your receipt no.),
enter the receipt # to get the automated response saying blah blah blah and also at the end saying this is the most upto date information on your case and our customer the same info national customer service agents have (i totally agree with this).
Then choose to continue to the next step "press 3" . choose 3
Listen to the options-
Option 4 "if you feel if you submitted together and one of the applications is left out and not processed (don't remmember the exact message text ..but something about companion case "

I still have a valid H1 visa but my wife is on her EAD and needs the AP to travel. Both our families are outside the US and it is imperative that we have the ability to travel outside the US at any given time. This is why I am pissed of. The last thing I want to do in an emergency situation is plead with some local officer and run around getting certificates from doctors. At times I really do question the point of all this. This process is not more important than family ... I will not have some stupid government agency rule my life in time of crisis.

I am also from atlanta georgia area. Have you contacted senetor/congressman? i would like to contact too. I have a couple of problems. For my 485 i followed the steps you suggested and contacted texas svc center! thanks for your help. The representative said for my 485 case no fbi name check is requested. But i have an email from FBI that said the name check was requested by USCIS on Jan 14, 2004 and FBI responded to USCIS washington DC center the same day. I think texas center just needs to get it from their headquarters. The representative instead said she would put a note for requesting one. It is so ridiculous, i don't know why i need to get into backlog of FBI name check queue if USCIS already requested and FBI already responded. I want to contact a senetor congressman to take this up.
The other problem i have is just like your AP, my wife filed for 765 renewal and the texas center processing date is one month past her applied date and still not approved. The stupid thing is they transferred the case to Dallas local office when we are in atlanta. First of all they shouldn't have transferred to dallas (as this is arenewal why they need to transfer to dallas?) second of all why to dallas when i am in atlanta? The rep said to that you send a letter to center to get it back from dallas to the service center. It is crazy. I am planning to go and get the temp 765 end of this month after 90 days but my case seems to be a mess.

I-140 ND: September 11, 2003
I-485 ND: December 16,2003 (Wrongly filed in CA center by lawyer)
FBI Name Check request by USCIS(According FBI email): Jan 14,2004.
FBI responded the same day to USCIS headquarters Wash D.C.
I-485 ND: Feb 11 2004 (after CA center transferred to Texas Center)
FP: April 20,2004
I-140 AD: Jun 25,2004.
1st I-765, Applied together with I-485 didn't get approved right away. Got temp card after 90 days in local office. Finally
I-765 AD: Jul 2,2004
1st AP (applied date don't have it but approved w/o problem)
AP AD: September2, 2004
I-765 for wife applied on March 28, 2005 with texas center
I-765 got transferred to dallas local office on April 04,2005.
Called up Texas Center on June 22,2004, rep says I-485 didn't move because
the Name check is not requested??
Asked about I-765 for wife, rep says send a written request to texas center
