It turns out you were right thankful if you remember the comments you made about my case and anakara's case that everything will be from anew. Now I have to do it all over. I have done yesterday fingerprint and photograph even though I did it in sept. 2005. So I have few questions here if you can comment on them.
My questions is I am expecting to have my interview in Feb. Once I do my interview if they approve my asylum application, how would I go about the I485? Do I have to wait the one and redo or there is other ways to do it. Remember my I485 is still pending with them. Also they sent me fingerprind and photograph notic without interview date along with it. Is that normal....

The term "nunc pro tunc" means backdating the new grant of asylum to the original grant date---to 2000 in your case. The whole point of this is to allow you to adjust status under the original grant. You do not have to wait another year and you do not have to refile your I-485. The I-485 you filed before is now being held at NSC pending the nunc pro tunc approval. Once you get the asylum approval NSC will go ahead and process the I-485. The last step should not be too long.


I see that you have posted in other threads (non-asylum ones). This whole nunc pro nunc thing is basically unique to asylum. Posting there will not be profitable for you. :)

BTW I do not remember saying that "everything will be from anew." I said that you have to do that BIO stuffs for another background check and have show up for a live interview with an asylum officer. I said that you do not have to prove the persecution. But the Asylum Office will not grant you a green card. That would be the job of NSC.

yeah you right with all the things you said. And it seems it is going in the direction you are pointing to.
the reason I posted my questions on other threads is the fact that I was not understanding what thread belong to which group.
And of course you are right, this nucn pro tunc thing is confusing and nobody knows about it. Every immigration I speak with gives different answer. and this is the reason I am posting my questions and situations for future quidance to nunc pro tunc people.
