In any Service Centers, your PD determines whether you can apply for AOS or not, if there is retrogression in visa numbers. Once you file, it's your RD that determines the processing start time.

The process is asynchronous, since they do not know if a person with a earlier PD will apply after you or not. They will start processing apps in the order they were received.

Now, I think it could be made semi-synchronous by refreshing the list and sorting them by PD any time a Immigration officer is ready to take on a bunch of cases. That way, at least every often, the list is sorted by PD. That's just my suggestion though, and I don't think USCIS is reading this thread :)

I happened to read this document at USCIS web site, and my understanding is that they START to process each application by RD. And my understanding of the RD is either the actual RD for direct submission, or the date of transfer, to a service center.

The above-mentioned document however does not explain how they approve cases once they started the process and send out requests for BC and NC. And my wild guess is that everyday they approve a number of cases which 1) have cleared from BC and NC and 2) still have PD in that particular month, still according to RD. -- Well, it is just based on my good will to make process fair enough to everybody but who knows...

As to Ooz's suggestion on dynamically sorting according to PD, well, I do respect it but I don't think that is fair to all applicants. Submitting I-140 earlier does not entitle one to receive a GC earlier than others who submitted I-485 earlier than him/her. Thinking of two different queues in front of two different windows (140 and 485). The application of PD is just to limit the queue length in front of the 485 submission window, not to decide who will be attended first in the 485 window; otherwise it is meaningless to queue in front of 485 window again.

pd052002,

Take a infopass and check. Your case might have already approved. Looks like, it takes few weeks to change the status to approved after orignial approval.

Infopass

Do you mean call the National service center or get an appointment to talk to a IO in person ?

I have done the first , They have created a referal and promised to get back in 60 day :-(

In my case there has been no LUD since transfer (03/07) , not even after latest FP in 05/07
