I recently transferred my H1 from one employer to another employer and I also got an H1 extension and I-94 validity until Nov-2009.

My Initial H1 B Visa petetion and I-94 is expiring ON 29th Jan 2007.

I want to get my H1 Stamped from Canada and want to re-enter from Canada.

I have booked a Visa appointment on 30th January 2007 in Ottawa.
I need to apply for a Visitor for Canada to go for th stamping.I am thinking of applying for Temporary / Visitor Visa at Bufallo consulate.

I have the following questions regarding Temporary Visa / Visitors Visa.
---------------------------------------------------------------------
1) What are the documents required for applying for temporary Visa?
2) Do we need to send our original passport to obtain the Temporary/Vistor Visa?
3) How long It would take to obtain a temporary/Vistor's Visa?
4)If I mail the documents which courier is the best way ?(USPS, UPS, DHL, FED-EX)?
5)In the application form for TRV form 5257-->Question 13 SAYS that " In the past 5 years do you or any of your family members stayed in a country other than your country of permanent residency/other than your country of citizen? If Yes pls give the length of Stay?
Our Permamnet Resident country is India and We have been Living in USA for the past 3 years. I went to India once and my wife went to India twice.
we need to fill From Date and To Date for this question.
How should we answer this question?
6) for proof of Income , can I submit the paystubs from my earlier employee?

I have the following questions regarding H1-B stamping in Canada Ottawa:
---------------------------------------------------------------------
1) Is there any risk involved in getting H1 B stamping from Ottawa Canada?(This is my second H1 stamping, I got it stamped once through my earlier employer, now I got my H1 transferred and going for stamping again)
2) Is it better to go o India (Chennai consulate ) to get the stamping?
3) what are the questions asked generally?
4) How long it will take to return the passport if Visa is approved?

If anyone can help me , it would really really great....I really appreciate your help on this...

I don't think CND is an option for Immigrant Visa stamping since you are not a PR of Canada.
Stamping is only allowed for PR or citizens. If you hold PR status or citizenship status in CND, then fine else please go to INDIA for your stamping. You can easily be refused and your money would be wasted. The only option is to buy a ticket to India from CND since US immigration would not allow you in without the H1B stamping. Good luck.

Canadian visit visa

I won't comment on whether you should attempt your H-1B visa in Canada or India. I will however answer your questions about obtaining a Canadian visit visa. I recently was successful in obtaining a Canadian visit visa for my grandmother who was visiting me in Chicago from Pakistan.

(1) Passport, original I-94 and I-797, travel details, proof of funds, explanation of the purpose of your trip
(2) Yes, original passport is a must
(3) Straight forward cases take 10 business days
(4) I was very happy with USPS
(5) Mention your stay in the US since you moved here with an H-1B
(6) Most recent paystub and last checking/savings account statement

Good luck!!!
