TD Visa renewal question (non-Canadian)

Hi,

I originally obtained TN visa for a fulltime employer that is valid until Dec 14th, 2025. My wife (Indian passport) got her TD visa based on that validity (Dec 14th, 2025) from USCIS in Canada. Then I added a part time employer in my TN and got another visa that is valid until July 2026. Recently while traveling with me, my wife received 194 valid until July 2026 and been staying in US. Few days back I renewed my full-time employer TN visa to Dec 2028. Now I have few questions on my wife's TD extension.

1) We plan to travel in June 2026 and planning to renew her TD visa matching with my new valid date Dec 2028. Is it possible to renew her TD visa in Canada (she is PR there) during June 2026. At this time her original TD visa would be expired more than 6 months.

2) Currently she is staying with valid 194 until July 2026, but her TD visa would be expiring on Dec 14th, 2025. Is it ok for her to continue her stay based on valid I94.

Your advice will be highly appreciated.

Thanks ..

Thanks, newacct for your time and reply.

On your reply to first question:

Is it a new TD application or TD renewal, how do we call it? Kindly advise.

It is a new TD application.
Every time you apply for a TN/TD visa or status, technically it is a new application.

Your wife can legally stay in the U.S. until her current I-94 expires in July 2026, even though her TD visa stamp expired on December 14, 2025. The visa is only required for entry into the U.S.; it does not affect her legal status while she is already in the country. She can also apply to renew her TD visa at a U.S. consulate in Canada in June 2026 to match your TN validity through December 2028. Being a Canadian permanent resident is fine, and she should bring all supporting documents, including your TN approval notices and proof of marriage, to make the process smooth.
