TD Visa questions - newbie here

Hi all,

I've been reading on the forum a lot, trying to learn before posting.

My husband is planning to get a job in the US on a TN in the near future. I would be on a TD (we're from Canada).

I currently have an online business here. I have so many questions related to that business.
1 - I understand that I can continue to make sales to Canadians only, but not to Americans, correct?
2 - if I incorporate the business before I leave, can I be an employee of that corp in the US - and then sell to Americans?
3 - can I do the service portion of my business in the US (I plan events for moms)?
4 - It is not a large business, annual revenues are less than $30,000 - is there a visa I could apply for in the US?

Employment is prohibited while on US soil (and on TD status).

Getting incorporated in Canada or selling anything to anybody does not mean anything. If you are on TD, you cannot work.
 
I spoke with an immigration lawyer (on justanswers.com) and she indicated that if i am selling to canadians only and filing my Cdn taxes, it is okay. Not the case?

So what about bloggers ... someone who blogs and earns an income doing so with ads on their site etc. Not okay?
 
As to what is permitted, as long as your work is strictly for non-US clients and neither you nor your clients are benefitting from your location in US, you can do the work legally.

You would not only have to file Cdn taxes, you would also need to file US taxes, as you would be considered residsnt in US, like your spouse. But you must ensure that you are not providing services to an American. Can you do that?

Since the blogger would most likely be accepting payment from US company, tha twould be illegal on any non-immgrant status.

As bigboy pointed out, the entity by which you are paid doesn't matter. As long as you control the operations of that entity, US immigration would look past this and say that YOU are working.

I wonder - is there a visa, that I could apply for, for someone who wants to start a small business like this there?
 
E2 is an investor business visa, and requires creating employment.

As you might expect, there are many spouse's of TNs in the US with little to do. That is the rules, and there is little that one can do to get around this. (School, volunteering, caring for kids)

It's probably THE major reason couples go back to canada (or at least one of them does) while on TN.

You'll be so happy to know that spouses of US workers who go to Canada on the equivavlent of TN, can work anywhere.
