TD to TN status

Hello,

I am a Canadian on TN status and my spouse is looking for work in US. We moved to southern California and my spouse and my children are on TD status, based on my TN status. If my spouse is successful in obtaining a job offer and appropriate documentation to request their own TN status, how do you recommend we proceed?

Do we all drive to San Diego/Tijuana Mexico and park on US side, then walk back to Mexico and immediately return to CPB agent in San Diego and request TN status for my spouse and TD status for myself and my children? Or do file AOS from TD to TN status via mail?
How long will AOS via mail take?

I am thinking is would be good to get TD status for myself and child. If some reason I lose my TN status (ie. merger or acquisition and layoff) it would be good to be on TD status based on my spouse. Can you hold TN status your self and TD status based on your spouse having TN status?

If for some reason, the TN status for my spouse is not approved, what happens? If my spouse is denied entry on the current TN application, can you continue to enter the US on the existing TD status?

This doesn't involve anyone but your spouse. You should not get TD for yourself, since that would cancel your TN. You can only hold one status at a time. Obviously you are going to keep your TN. If you lose your job, then simply go to border yourself and get TD.

So, SHE goes to Mexico and gets her TN. That is it. You already have TN, and your kids already have TD (which is good as long as EITHER parent has TN).
If het TN petition is denied on some technical reason she will still be allowed to enter on her TD, she would then fix the problem and go back and repetition.
Just to clarify, if you ever wanted/needed to change to a TD by mail you would ask for a CHANGE of status (COS, not AOS which is for green card)) using form I-539.
