TD renewal with DUI

Hi all,

Without the lecture on drinking and driving (I've suffered enough pain and paid my dues both personally and financially)..
Haven't touched a drink in almost 3 yrs now, nor will I.

I received a 2nd misdemenor DUI while on a TD. (Canadian)

I realize there will be discretion involved in both circumstances...
But any thought if would be better to attempt to renew personally at border with wife or file an EOS (I-597) ?

We also have a son who has recently become a US citizen thru marriage...
Not sure if going to stay in US indefinitely yet but he could sponsor me (us) for a GCard.

Any thoughts on what might be the best(safest) route at least for the next couple of years ?

If you have not had trouble crossing the border since your DUI, then you will not have trouble getting a new TD, it is a non-immigrant status that is reevaluated each time you enter. Its up to your if you want to go to border or renew by mail with form I-539.

As to applying for GC thru son while on TD, I would just make sure my TD is valid for a few months and then file for GC.
You can look on a family-based immigration forum. I would consult a lawyer at that point about any police record you might have and how it impacts GC process.

I have not tried to cross since DUI...

Of a green Card or TD extension(mail I-539)....Do u have an opinion which would be the safest route ? I know that AOS's added some discretionary measures last month. No one seems to be sure about them as relating to DUI's. Thanks again !
 
You will still need a TD first be fore pursuing GC (which is a different process). I suggested you look elsewhere for advice on GC, please follow that advice.
 
I'm currently on a TD ....

We submitted the GC AOS (i485/others) paperwork yesterday.

So, your status will be "adjustee" until you get GC.

Dis your spouse also submit I-485, etc? If so, she must wait in US until she gets EAD or she will not be able to re-enter US on TN. Same for your TD, but since you aren;t working that is less crucial. I hope she has time remaining on her TN?
