TD Question

Hello,

I am a Canadian citizen and my wife is not. I just got my TN extended through I129 and so was my wife's TD (through I-539). My wife is planning on going overseas for a month. Can she do so without any issues? just present the I-539 approval along with my TN Approval at the airport? I am concerned because she is not a Canadian citizen, they may giver her hard time when she comes back? Please advise

Well, she needs a consular visa, so, yes, she will have problems getting back into US unless she gets a visa before returning. the I-539 is of little value once outside US, since she needs the visa as well. With the visa and a copy of your TN I-94, she will be readmitted.

Does she not have a consular visa now? If she does, and she is only going to Canada or mexico, she can use AVR to re-enter on existing, even expired visa.
 
Thanks nelsona. She does, but she is going overseas. Does that mean she has to make an appointment at the US embassy at her country of birth and show my TN/I94 and her I-539 as well as her expired visa to geta new Visa?

She needs a copy of your TN. All other things are not important. The I-539 kept her in status while in US. Once outside she needs a new visa. her TD I-94 will be issued at border with a copy of your TN.
