I am on a TN and my wife is on TD - both expiring soon...I plan to renew my TN from Toronto, but we just had a new baby here in the US. This complicates things a bit... The pediatrician said that it is too early to fly the baby. Can I file I-539 with Nebraska the same day that her current TD is expiring? The form says that I should attach form I-129, but I don't plan to file I-129 (I am going to TO anyways and will renew my TN at the airport). What is the best way to renew my wife's TD? Any help is appreciated.

Thank you!

Why don't you get a new TN by filling out I-129 and send it together with your wife's I-539? The things will get complicated if in case (for some reason), your TN does not get approved at the Toronto airport..

I am going to Toronto for work also...by filing I-129, this means you cann't leave the country while your application is under review. Isn't that correct? My question is, can I file her TD(I-539) without an I-129? Thanks.

-- You can file your extensions after you come back from Toronto. But if you really want to get your TN at the airport, you could do that. Yes, you can file your wife's I-539 without your I-129. You will need the proof of your (new) TN that you recieved at the airport.

Thanks Bigboy00! Yes...I assumed that I-129 is filed with the I-539 if both me and my wife wanted to renew via mail...I guess I can also add a doctor's note to the application...

You're not late so long as the application is received before the original I-94 expires.

Do you know if the Nebraska service center has a hand delivery address ...the address on the I-539 form is a P.O.Box#...I wanted to send the form via Fedex to make it on time (before the current TD expires)? Thank you!

Is the center for TN/ TD renewals Nebraska or vermont? Need to send out the form today and I thought it was Vermont now.

Please advise.

Thanks
