Taxes. Could it be a problem? please help

Hi,

I have account transcripts from 2005-2009.
I requested from the IRS my w2's because one of them(2005) I could not find it.

In 2005 my husband had a job for 1 month and he tried to get the w2 from his employer but he could get it. The thing is that the employer reported the w2.
We did not reported in our taxes of 2005 because we did not have the w2 and thought the employer did not reported it.
We saw it from the information we requested from the IRS. We do not owe any money to the IRS and filed the taxes for the 5 years.

We do not know what to do. Is this an issue??. We are scared they could think we made fraud because we did not reported the w2 for that job.

Best thing to do is to contact a local CPA and try to do amended filing, if necessary. You don't want to assume things when you are going for naturalization, do you?

The problem is that we have the interview in 2 weeks. We known about the problem yesterday.
I think USCIS check if you owed something to IRS.
We don´t know if we have time.

I am not sure but I think USCIS check only if you filled your taxes for the 5 years. You can have mistakes in your returns that CIS even don´t know about it. It is IRS who can get the mistakes.
N400 application ask you general questions about taxes:
- Have you ever failed to file a required federal, state, or local tax return?
- Do you owe any federal, state, or local tax return that are overdue??....

So I think USCIS is interested in you have been a good citizen doing your taxes and don´t owe anything to IRS.
 
One of the tax preparers told me that it is very hard to file taxes older than 3 years, and the only way might be through a criminal courts / amnesty program. Given that you have paid taxes (not tried to cheat), and IRS has the W2 but did not demand a correction --- I would not worry about it. I think you are current on all taxes for all practical purposes.

At interview you wouldn't tell IO that you failed to file taxes. Yours was a honest filing mistake ..stop worrying about it.
