Tax2003: EIC & public charge ?

Can I benefit from EIC (Earned Income Credit) since my 2003 income is low enough to qualify it.
I've been unemployeed many months last year and did not apply for the unemployment in order not to become a public charge as experts here recommended to keep my I485 safe.

I'm filing 2003 tax now and TurboTax-web tool lets me qualify EIC, but I'm not sure if EIC benefit leads to a public charge or not.

It's a tax credit for low incomes, not welfare. Of course you can claim it. (And you could have claimed UI too.)
 
Not to sound too clever, if you are earning as low as to be eligible for EIC, then I am curious to know what are you doing in this country ? Are you in the family based category ?

I think this is the main reason people like us get into this indefinite waiting game in 485 since BCIS wants to make sure that all of us dont become public charge. They expect immigrants to at lelast increase the GDP. (security verification cannot take 2-3 years)
