Tax transcript quandry

I filed form to get my tax transcripts from 2004 thru 2007 earlier this year in anticipation of N-400. I got those for 2005 thru 2007 but the letter said they had no record of 2004 tax filing. Today I called IRS to also order the 2008 transcripts. The automated message said I could order for something like 8 (or was it 10?) years - so I tried again to order 2004 in addition to 2008. It said it couldn't provide for 2004.

So I went ahead and spoke to a customer service agent who suggested I once again send the request to the service center using the form. She also verified that my account indeed showed I had filed 2004 returns and also that the check had been cashed.

So now if the new request again comes back with "not found" - how do I get that? She CSR said she had no idea! Anyone know if a FOIA request may help?

I gues you aplication is marriage based; otherwise don't worry about this
tax record issue.

No - actually my and my wife's cases are based on 5-year only. I was getting transcripts ready 'cos many a members on this board had mentioned it was better to have those ready. Our case is pretty routine - no long trips, no trouble meeting residency requirements etc.

You can get them but there is no need to make a big deal out of it if you can not get them. Bring your own tax return copies instead.

Too much preparation can make thinsg worse. I think it is better to keep
documents needed minimum

Really? I do not agree with that advice. That is strange advise coming from someone who asked whether to shake hands with the IO or not in a previous post :)

I would say that being overprepared is better as far as documentation is concerned. You dont have to fish out all the documents unless asked for.

And if the IO decides to ask for it, and you dont have it, you could be watching paint dry for the next two months.

I was mailed account transcripts for 2008, and the previous 3 years - 2007, 2006 and 2005 at no cost. any prior years the IRS informed they do not hold but if i wanted a tax transcript prior to 2005 that this was available at a cost of $57 for each tax year requested (prior to 2005). I paid the $57 and received the transcript for 2004, now i have 5 years tax records if needed for the interview.

All the transcripts are available for free if you walk into your nearest IRS office. For those people who do not have an IRS office nearby this may not be possible of course.

I guess your application is marriage-based

Mine was not marriage based and well over 5 year GC anniversary. Tax documents were requested by IO for my wife. It is better to have the docs if you don't want to wait without knowing any status.

Not so -tax transcripts are only available for the current year and 3 previous years and are free - you may strike lucky with a personal visit and they give you 5 years, not so for me and many others.

Prior years you need to order a copy of the tax return and you have to pay $57 per tax year requested.

here is the link, second paragraph applies to transcripts.

There must be a reason it is requested. If it is randomly requested, the IO
is out of his/her mind. I did not say one should not make efforts to get them.
I got tax transcript myself but I think you should not worry too much
about it.
