Hi All,

My lawyer messed up my papers and did not sent one of my tax return copies while filing with 485.Instead she sent a plain white paper for one of the
continuation of the tax return,she says the copier didnot copied and she says not to worry b\'cos INS will have full copy of tax return.

Is this true?If INS has all those why do we need to send it again and I see
most people getting RFE\'s for tax returns,etc.

your answers are highly appreciated.

INS & IRS are two different Organizations

I know that INS and IRS are two different organizations and I know
INS do not have IRS information.But if they want they can request file
from IRS.
 
I wondered when my attorney told INS have full copy of my tax return.

I was amazed and asked her why they will request for rfe if they have
copies of tax returns.

I wasn\'t satisfied with her answer and may be she told because not to worry too much as she sent a plain white paper(copier problem).

I know that tax returns aren\'t required at 485 stage but to avoid any future rfe i send her last two years tax returns.

No need to worry

Tax Returns are not needed (99.9%) of the time. One in 1000 times they issue a RFE for W-2, Employer Verification Letter, and/or 1040 for last 2/3 years.

You may not be that unlucky...hopefully not!!
 
IRS 9003

Thanks for providing the info.

The document shows INS discontinued using the form IRS9003.

"The IRS no longer uses the hard copy of the Form 9003 to collect tax-related information on applicants for permanent residence. Tax enforcement in this area is now accomplished through other means."

They did not provided info on any other means.

tax return is not needed for your 485

but INS needs tax return for your spouse\'s I485 (not always).
This is what my lawyer told me.
