Tax returns

Hi everyone,

I'm going to include my income to reach the 125% edge.

I'll include tax returns for 2003,2004 and 2005.

Is it Federal Tax Return enough or do they need State returns?

I can't find my 2003 NYS Tax Return.

Also, do they want copies of W-2s?

I don't see them wanting your state returns as the amount of money you make is the same on both... The only difference is the taxes.

However, I would bring your W2's since you are using your income also. The officer might want to see how much you make and also how much your spouse makes independent.

It is better to bring everything and be over-prepared, then under-prepared and get a RFE.

My future wife (sponsor-USC) is in law school, therefore is unemployed.

I'm right now reading the I-864 instructions and it clearly says that the sponsor must be employed, regardless teh fact that the sponsored immigrant is in the household and his income qualifies.

Should we just get a joint-sponsor (my father in law) in order to avoid getting a RFE?
 
It is definitely safer to get a co-sponsor.
My wife had only 1 year of Tax return due to Grad school, but that was fine conbined with my income. Depends on the officer I think, and also how close to the 125% poverty line you are. The ultimate goal is to determine that you'll not be a burden financially.
 
Does the tax return have to come from the IRS, meaning filing forms f4506? Or is it just a copy of the tax return that was filed and mailed to the IRS plus the W2s?

You can submit a copy of your 1040 you filed. Even better is to submit tax transcript from IRS (Its easy to get them... one phone call to IRS).

If in any of the most recent 3 tax years, you and your spouse each reported income on a joint income tax return, but you want to use only your own income to qualify (and your spouse is not submitting a Form I-864A), you may provide a separate breakout of your individual income for these years. You must also submit copies of your W-2s for each of the most recent 3 tax years, and if necessary to meet the income requirement

Instructions say that sponsor should file I-864 even though zero income was reported by the sponsor during that tax year. The instructions also state that sponsor must meet the minimum income requirements via income or assets. It is not mandatory that sponsor should be employed. If sponsor is not employed or has zero income, the sponsored immigrant can include his/her income to meet/exceed the requirement. If all fails, a joint sponsor is needed.

What I've done, I showed assets (bank accounts, CD's, Stock Market account, etc.) with a total amount well above the 5 x poverty line. I'm pretty sure it will be enough for the purpose of the I-864.

You shouldnt have a problem as you print your own currency :p
