I am currently on H-1B status. My employer is thinking of filing my GC. Could you please tell me if my tax returns are required at any step in the GC process. If so, for how many years? Will I have request the IRS for the tax returns during my F-1 (student) status also? Please let me know. I shall highly appreciate any response. Thank you.

The first step in the GC process is Labor Certification. This step does not require Tax Returns. In filing I-140/I-485 after the LC is approved, you may require Tax Returns. It is not necessary that you have to submit all tax returns, but if USCIS wants to see any Tax Returns then you have to provide them. It is good to keep all the tax returns handy in case you need it during I-140/I-485.

I had struggled around before to find out all about this tax thing for GC purposes. You DO need to submit tax forms at the I-140/I-485 stage. Its a part of the procedure. That's the reason I told my employer to deduct the SS taxes and also I paid back every penny of the SS taxes previously owed.

What does SS taxes have to do with GC application? If you are not a resident or Citizen, you're not eligible to collect SS. I know, when you get GC, you'll eventually be able to collect.

Any thoughts??

Well, atleast thats what my lawyer said. I guess I should be believing him :)

You should believe USCIS, not your lawyer. Read the I-140/485 forms. Tell me where they list tax returns under the section "Required Initial Evidence". ;)

Well, I would rather leave the reading and understanding laws to the lawyer. Afterall, that's we are paying him for right? I know this whole GC thing suks....anyways, whether they ask for it or not, i guess no harm in being prepared!

No offense, but with the quality of many attorneys out there, that can be a very dangerous attitude.

Well, my attorney for GC is Rajiv S Khanna. So I guess there's no question of quality; which proves my safe attitude ;)
