Dear friends,
i applied for naturalization based on 4 years because i have reentry permit,
now that's my interview is close,a lawyer told me that i have to bring with to the interview a 5 years tax return transcript and proof that i had connections with the US while abroad like checking account ...ect
The probtem is while i was abroad on reentry permit i didn't file tax return for one year because i wasn't working but i was at school.
Can that create for me a problem in the interview? Any advices please

You are required to file a tax return in the US, even if you did not earn anything here or any other global income. I think you should show evidence that you were studying during that period and did not earn any income and thats the reason why you did not file a Tax return. If you have proved everything else that they need, by showing your Checking Account/Credit Card etc etc and tax returns for other years, I think they will be pretty considerate (and this is an election year also !!!).

Hi fmg

hi fmg,

just curious, you said that you had reentry permit - which means u have been outiside US - and also u have completed the 4+ year requirement for USC.
and also ur lawyer had asked for the details of 5 year consolidated tax returns.

i am assuming you were in US for some time before u went abroad for soem time and came back.

so if lets say u got ur I-485/GC approved in a year 1997 (say!) did the tax reutrns ought to be from only 1999- 2003.

Basically my question is - if ur filing for USC at a certian date- do they ask tax returns and other stuff - 5/4 years predating the application date?? - or from the date ur I-485/GC was approved????

If NOT - what if someone applies USC after 10 years, do they have to
1. show consolidate tax returns for all 10 years
2. show they have been maintainging status right from the start
etc....

Someone more knowledgeable can correct me if I'm wrong, but based on the wordings of the questions and the document list requirements, I interpret it thus -
The questions about federal taxes mention "Since becoming a LPR have you ever ...". So while it may be true that USCIS lays more emphasis on the last 5 years before citizenship application, there is nothing that precludes them from asking for your tax records for the entire duration of being a LPR.

Remember ultimately that tax filing is used along with other information and supplemental proof you provide, to determine if you "abandoned" your duties as a resident of the US.

Not a legal opinion, just my interpretation.

how about the highly debated " 6month - 1year stay in the GC sponsoring company"

what kind of proof do they want interms of employment history- say at the end of 10 -15 years of GC- if u decide to go for USC???

do u have to save allthe paychecks...................to prove that u did stay 6-12 months after getting GC.

because given 10 -15 years some company may not exist anymore and its hard to prove (or NOT prove by USCIS) that u did NOT break the law
