I had a question related to Federal taxes. I know, this is not the right forum to discuss this, and I am sorry about that.

I am on H1B and stay in rented apartment ($1000 / month). Can I use Itemized Deduction on my Tax Return and claim Rent as deduction.

I have been using Std Deduction for last 2 years, but few days back I met a guy (also H1B from India) who uses Itemized Deduction and deducts all his expenses(Rent, Car depreciation, Furniture Depreciation, even his laundry and grocery expenses).

His argument is that his real home is India, and he is here only for few years, so he is entitled to all these deductions.

Folks, wht do you think is right?

Jail is another word for home...

Your friend could very well be calling home some federal jail in the future...
 
Those are not deductions.

Don\'t follow your friend. If he is audited by IRS he has to all of his salary is penalty. he is OK untill he didn\'t get caught.

rent is not deductible from Federal Taxes

Some states allow a small deduction for rent. You better consult a CPA. My opinion is that he is evading taxes. If you plan to go back to India it might not affect you but if u plan on staying don\'t take the risk
