Tax Question for Naturalization

Hi,
I am a legal permanent resident since 2000. I got married in 2002 and my wife is still in my home country. I can apply for naturalization in Feb ‘2005.

I filed my tax return for both 2002 and 2003 as a single because my wife doesn’t have ss# or itin. As far as I know, I have to write down my wife’s ss# or itin in order to file as a married filing jointly or individual. Now, I know I can file amend return for those two years once I have my wife’s ss# or itin. The question is:

**Would it be a problem for me (naturalization) because of my single filing status even though I am married?
** Is it possible for my wife to apply for itin while she is in my home country?

Reply to my e-mail would be greatly appreciated. Thank you for your time and help.

If you are not filing on the basis of your marriage to USC, which should not be the case (you would have two wives), but on the basis of being a legal permanent resident for 5 years, tax documents normally are not required.

Your best bet is probably to consult a CPA just to make sure you filed your taxes correctly. You might have to amend your returns.

Few piece of info:

Even though your wife got SSN, you may not be able to get any tax dedution for the amendment. Because she is considered as Non-Resident Alien for these Tax calendar years you'd like to amend.

You should consult Financial Advisor or CPA regarding this.
