i am an immigrant from ireland who married an american citizen in sept. 2003 iam about to file for aos but am concerned about my wifes tax retuns as she filed singly for that year . she did this on the advice of her accountant . he advised her that i did not have a social security number therefore she could not claim me as her spouse. should we go back and ammend her tax returns and what do we do when her 2004 returns are due in afew months ??????????

No need to ammend the tax returns. What your wife's accountant told her was in line with the IRS laws. She should have filed single. You must have your marriage certificate. That should he enough to prove that you guys are married. Ofcourse, you will need lease papers, utility bills, bank statement etc.

yeah the irs guy was correct.

If you had a ssn then you two could file joint.

also you need some kind of proof you two have been living together.

Just make sure you bring whatever you have to the interview
