Tax Documents

In the document checklist for the documents to be submitted with N-400, there is item#4 under the heading "If you are applying for Naturalization on the basis of marriage to a U.S. citizen"

4. Documents referring to you and your spouse:

• Tax returns, bank accounts, leases, mortgages, or birth certificates of children, or

• Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past three years, or

• An IRS tax return transcript for the last three years.

My take is that we could satisfy just one of the above bullet point and within 1st bullet, we could just furnish any one of the items that are listed. Am I reading it correct?

Also, what is meant by the term "Tax Returns"? Just a copy of what we sent to IRS while filing Tax for the year? All the pages?

Not that I don't have more than one item. Just curious on how people interpret these instructions. For instance, if I have birth certificate of the kids, I shouldn't be sending anything else that is listed under #4.

I just completed by interview on marriage based. I apply for IRS transcript and they will almost sent you 3 years transcript within 1-2 weeks. and also send all the document which shows both of your names on it.

hope this will help

Thanks smithjohnatpa.

I can gather as many documents as listed in the section. I am not sure if I really need to collect everything and include them with the application. For example:

Do I really have to include - Tax Returns + Lease + Bank Statements + Birth Certificates + Mortgage Docs ?

I would say carry everything listed during interview.

For now, send you application with as much as document you can collect.

Make sure you take the tax transcripts and account transcripts obtained from IRS directly. They are free and can be ordered on phone. And take the other stuff (bank stmts, birth certs, mortgage docs) if your case is marriage based. Although the documentation says "OR", the IOs can ask 'AND' and there isnt much you can do - so good to have docs ready. You can always ask for supervisor if you want to challenge, but it depends on you.

Do not submit any additional documentation to IO unless asked for. At my interview, IO asked if I have anything else to show him. I replied by asking if he needs anything else from me - and that was end of that conversation. He didnt ask for anymore docs.
