Tax deduction for GC medical check?

Has anybody taken a tax deduction for the medical tests done as part of the GC? As far as I know, work related expenses are considered tax deductible. So, if I am applying for employment based GC, I should be able to claim a tax deduction for the cost of the GC medical test right?
 
You should read the relevant IRS booklets on deductible business expenses. I personally wouldn't deduct it, because many business expenses are only deductible if they are travel-related or if you are self-employed. There are some expenses I think that are deductible if they are necessary to "keep your job" but I'm not sure of the details. Also, if you are deducting medical expenses, why not deduct filing fees?

i wish i could deduct filing fee - except that my company is paying for it. :)
 
Your job is GC related, not the other way around.

Don't push it. Your guys all earn descent salaries. Be proud and pay the bills.
 
I don't think it is about pride. If IRS clearly says that it is tax deductible, verify this, and deduct it. If the government says you should not pay taxes on it, you shouldn't. You can spend that money into the economy instead.
 
hey tyzh - i do pay my bills... i just don't feel the need to pay more to Uncle Sam than i have to. the way i look at it, if the IRS tells me i can take a deduction, then i will.
and your note that my job is GC related seems a little absurd. my company feels i am important enough to them that they are willing to sponsor my GC to retain my long-term services, just as i am sure u'r company does about u. they do, right?
 
Nothing wrong with taking legitimate deductions. It's silly to throw money away. I lived in Spain for six years. I paid no US taxes at all during that period since it was "foreign earned income" and I was entitled to a $70,000 per year tax credit. I did not pay Spanish taxes as I was there under the Status of Forces Agreement between the US and Spain. It would have been incredibly stupid to pay taxes when I was not required to do so (I did file tax returns every year though).

If I want to make a charitable contribution I will do so but I doubt that it will be to the US Government.

My apologies, but aren't US residents taxed on their GLOBAL income? Somebody from IRS (nasty audit) told me that all U.S. residents (obtaining a green card) technically are supposed to pay taxes to the U.S., even if I earn any money in my home country.

By the way, does a continuing IRS audit pose any problems for I-485? If I settle with the IRS (under the Offer In Compromise law), will the INS come back and deem my taxes "unpaid" ?

LOL yeh go ahead and pay your share to uncle Sam may be lil extra. We will try to save whatever we can . Why should i pay extra cause i earn more , thats crap thiking.
 
Like I said, it's not a job related expense. You do NOT need a GC to keep your job, but you do need the job to get your GC.

Of course, with everage Joe's salary, a couple hundred deduction won't get you audited. So either choice is OK. But I won't bother cutting corners like that.
 
Can we deduct the lawyer fees/Visa fees and the medical fees too?

Anybody have any experience (or heard of) doing this.

I know if is just the one of these fees then probably i will let go, But I paid around 4-5k for myself and family? My employer decided halfway that I take care of everything!

Any suggestions TIA

I have the same thing, I [paid my lawyer so much money for the process (i485), what is deductible, Jim, your thoughts on this would be great
