Can the Cost of the flight and other things ( fees etc) be written off in the tax deductions because anything you do to keep yourself in the job can be tax deducted as per my tax consultant.

Has anybody taken it before ?

No - you cannot

This is not your job related expense. Your residence status and job are interlinked, but is tax law it is not considered the same. You are applying for your GC in order to save your job and this cannot be considered as a job related expenses.

not tax deductible

any trip that you make, whether for GC or H1 or anything is absolutely not deductible. you are not required to travel to India to work in this country. you go to India only because of personal matters. so it is not a business related expense.

luckily, my entire trip was sponsored by my company and so i am not worried about the tax deductions anyway.

I beg to differ...

If the trip is scheduled with just CP in mind-in other words not a \'vacation\', You may be able to deduct the airfare and expenses as a job related expense. Even though one may work on H-1b, that is not a permanent arrangement and without a greencard one may not work in US permanently. It depends on how you argue your case.

Theoritically ......

It does sound like "JOB RELATED EXPENSE" and could be deducted.
In practice I dont know if this is ever done. But would be worth a try.

$$$$ Will take a chance this time $$$$$$

Since I was AC -140 case and my lawyer had written in the hardship letter that I need to go for consular processing as it causes hardship for me in terms of promotin, raises etc..guess it seem like a job related expense..

So did my attorney

My attorney asked me if I had meals vouchers etc.. Since I did not have any he said that he can take $45 per day for my entore trip of 30 days as tax deductible

So finally it came down to Airfare + (30*45 days ) which would come in tax deductible

Can we expense attorney fee though?

I am paying 50% of attorney fees and being co-operate attorney it is pretty expensive.
Can I deduct my attonrey fees for
- H1
- GC

I see strong case for H1 though

Thanks

What CPA says

I was with my CPA yesterday. He straight away refused GC expenses. I had hard time to convience him that fees paid for H1 should be tax deductible (I pay 50% of legal fees). He finally entered as itemized.

Has anyone discussed with CPA about GC & H1
