My STEM OPT EAD is ending soon (say 1stJuly 2025). I am departing the US and moving to another country but will be employed by the same employer (a FAANG). However to mitigate double taxation on RSUs I have to stay a few days on US soil on grace period (say 15 days). My start date in the destination country would be 20th July 2025. During this period (i.e. between 2nd - 19th July), I would be placed on work suspension by the employer as my EAD ended. My employer has a policy (internal document) which states that I can take already earned Paid Time Off during this work suspension period.
I am worried they would show days after EAD as employment days (should actually be shown as PTO but idk how they will show the pay check - no control here). I would like to be back in US on L1 someday.
1. How legal it is to take PTO (for earlier done work) for days after EAD end date (i.e. during 2-19 July)?
2. Can I avoid the grey area by moving to a 3rd country/change of status to B1/B2?
