Hey guys: Of late, I stopped visiting this forum. I was busy with work. I have applied for H1 thru premium processing and got it within 2 days from Vermont center. So I changed status from EAD to H1. My attorney replied to my 2nd RFE on 01/25/2005 (same day delivery), it is due on 01/27/2005. He says that as long as the post mark date on the reply envelope is on or before 01/27/2005 we are fine. If i were you, i would call the FBI and if they have sent back the inquiry(which they generally do within 24 hours), then, most importantly, fax the local Senator/Congressmen with details of your case.
My local Congresman, Pete Stark, sent a inquiry to USCIS and was told the same online status report. He then send a second fax inquiry to USCIS along with the AOS reciepts and the very next day, my AOS was approved !!! Even before the USCIS sent me the approval letter, i had snail mails from the Senator and Congressmen with the approval notification.

My posts on writing to the local Senator & Congressmen for all the old timers might start sounding a little monotonous, but i believe it will work.

I contacted Pete stark asking him to inquire with FBI about my name check. His office said they contacted FBI and it is still pending name check and there is nothing he can do to expedite it. What do you suggest I do next?

Hi desi_alien, how do you know it is in 'name check'? did they specifically said so? (800 national line or emergency #?)
I thought we should already gone through name check before they issue the long expired re-FP (??!!) else what did they do in our 3 long years waiting of 485?

Response to my inquiry after 2nd FP is "...in line for adjudication...allow sufficient time for processing." Now only if one can define that 'line'...

Like leee said, if this is a 2nd FP, there should be really no name-check. You could try and point this out to the FBI. But other than that i guess there is not much you can do untill the name check is over.

I believe the Congressman's office has a better say with the USCIS than FBI. However, do continue correspondence with the Congressman's office for the USCIS.

Well My first FP was done in Oct 2002. The case was probably then thrown in some dust bin till dec 2004. That is when I contact my local senator telling them that my 2nd FP was long due and they have not sent me FP2 inspite of me and my attorneys requesting it with three written inquiries. And then the magic happened, within a week I got my FP2 appointment and the same day FP was cleared (Jan 5 2005). My attorneys followed up a week back and they were told the case is pending 'name check' and in thier (attorney's) opinion there is nothing they can do except to count beads. When it happens it will happen. Well, I donot believe them as they said the same thing when my FP2 was due.

I will wait for a week and call the congressman's office again and see if they can help me.

What is the FBI number to call to check on the progress of "Name Check".
ANYONE KNOWS?
