Guys, above are the original words.

I think Murthy was only referring to AC21 portability. That is, even if I-140 has been revoked, I-485 "should still be approved" after pending for 180 days.

I don't mean to spoil the party. But the question and answer above may have been misunderstood by many of us. The true meaning may be just to clear up AC21.

Therefore, the purported memo may just state that a revoked I-140 wouldn't affect I-485 after 180 days.

THE MEMO MAY HAVE NOTHING TO DO WITH GRANTING US INSTANT I-485 APPROVAL AT ALL. The only good it does is we won't have to worry about employer revoking I-140 any more. And that is it.

Sure, I would love to see myself wrong.

there was a specific question about ac21. ms murthy said that a memo on ac21 will be released by september of this year. and then, ms murthy answered this question. this leads me to believe that this might not be about ac21.

Murthy's explanation is quite clear and simple but just not understood by most people.

1. Read Muthy bulletin, you'll know *AC21 Regulation* won't come out anytime soon, meaning we won't see AC21 REGULATION this year.

2. However, a memo or guideline will be released this week/month, which is like AC21. REMEMBER: the current AC21 is a MEMO, not a LAW. The only purpose is to guide the adjudicators to take action properly when he/she is going to make decision on a case. AC21 MEMO is not very clear, so a CLEARER and AMENDED MEMO will come out.

Again, REGULATION is NOT A MEMO. REGULATION IS LAW, EVERYBODY MUST FOLLOW. MEMO is only a guideline, can be flexible or changed.

That is it.

Conclustion: No instant approval at all. Just an amendment of AC21 MEMO.

ac21 was a regulation that was signed into law by the then president bill clinton. agreed ac21 was vague and a new memo is being released in a couple of weeks to make a level playing field for all the service centers and local offices regarding ac21 and revoking of i-140 by the employer.

however, i still cannot understand what remains in ac21 regulation. what is the ac21 regulation that everybody is waiting for???

I think we missed the fact that something like instant approval of 485s wud most probably have to be a law by the senate etc rather than a internal memo from INS...it figures!!
 
thats what even I don;t understand what people think for Green card. How can you get instant approval.
Come on kids come out of these.

this is all regarding. AC21 only nothing else. don't take it like all 485 would be approved if they are pending for 180 days. Again apporval depends all new security checks.
