Hi all,

Is it possible to switch back to valid H1 if EAD is not approved before the current EAD is expiring??

Appreciate your thoughs and comments.

Kamal

if you have valid H1b visa stamp in your passport then go out of USA and enter on H1 status and show your H1 Visa stamp and get I-94 based on H1b status

Ginnu,

Thanks! I don't have valid stamp in my passport. But, I do have a valid H1 petition. When I returned from India, I showed my AP and entered into US. Immediately I filed I-9 with the copy of my EAD. I renewed my EAD promptly. Now, my 3rd EAD is pending with INS but the current one is expiring by MArch 31st. Can I use my valid H1 petition to be eligible to work when my EAD expires??? I have not changed my job and working for the same employer who is the beneficiary for my H1 and sponsor of my Green Card. Any thoughts??? Please reply..

----- NO, you have lost H1, other option for you is to go out get H1visa stamp based on H1 approval notice and enter on H1 status, for more info go to your lawyer
