Hi as you can see the title.I wanna talk about switching from CP to AOS.
I got 1stNL middle of May 2009 and send it back to KCC beginning of the July 2009.I wanted to go with CP because of CN(EU2099X).But,I may have a army duty problem by the time interview day.(for now i don t have any problem.I am just dealing with paper works. But, I might be late).According to Turkish Laws,If you have army duty problem. You can not go to another country. So even if i get the green card.I am not going to be able to come back to USA.

Now,I saw a link on another site which explain switching from CP to AOS.But,acording to this explanation. It is basicly going like AOS.There is just an extra job.You need to inform USA embassy which is in your country and say them i am going to do AOS.At this point.Isn't it good idea to go with CP and if my CN become current very early. Then go with AOS.Then people doesn't have to decide between AOS or CP.Just go with CP then if your number become current early. Then go with AOS.If not stay with the CP

(All you have to do is just file Adjsutment of Status application with USCIS. As USCIS already has your original petition, they will take care of everything and you don;t need to anything else.

If you have already started your consular processing, as amatter of courtesy, you should inform the consulate that you have decided to switch to adjusment of status. You should also inform NVC about the same, as it helps them to streamline their file storage.)

Explanation is at the bottom of the page.

Thanks for ideas and replies.

can i do that even if KCC send my paper sent to the consulate.Because according to that link. You can do that even if they send you paper to the consulate.in this case you just need to inform consulate.

The link is about cases processed via NVC. DV cases have nothing to do with NVC. That is probably still possible but will take longer time.

They usually don't transfer your case to the consulate until just before the interview. If you call KCC they will tell you what to do. They told me to email my details and the fact that I wanted to switch from CP to AOS.

Hope that helps

hi nlhanhla.can you give us more specific information about your case.Timeline of your case. When did you get your NL.When did you send it back. When was your CN current. What was your CN and when did you switch from CP to AOS.Thanks in advance.Bye.

I don't think it matters when you send in your 1st response. If you want to change from CP to AOS just try to do it at least a few months before your number is current in the visa bulletin. That way you can be sure they would not have sent your file to your embassy in your country. As for your case, you seem to have just sent your papers in so wouldn't worry about them having even looked at them. The other information is on my signature.
