switch between H-1 and EAD

Hi,

I have applied for I-485 and it's been 8 months. I guess I can use AC21 and switch to a new employer. I am also maintaining my current H-1 and it is valid for 3 more years till 2005. (H-1 stamp in passport).

I am planning to switch jobs as I am getting laid off. Can I use my EAD to work for the new company?

I am also planning to apply for H-1 with the new company too as I need it to get my spouse on H-4. Is it possible to work on EAD and switch back to H-1 whenever its approved?

Can I use H-1b premium processing to get this new H-1?

hi

technically, there is nothing like switching to H1 or to EAD. If ones H1 expires, and he has EAD he can use it. And again 485 is denied, he can file h1 again.

I tbink you can do that.. I dont see any issues with it
