Supporting documents?

Hi Everyone,

I efiled my I-140 and submmitted my supporting documents through mail on Dec. 12. The supporting documents should arrive TSC in one or two days. However, till today, the status of my case hasn't changed online (no sign that USCIS has received the documents) althought the last LUD is Dec. 19. I wonder if this is normal and how long it takes for USCIS to update the online status of the case and show that they have received the supporting documents.

Thanks for your information and happy holidays.

I don't think the online status would explicitly say that supporting evidence has been received. The LUD on Dec 19 might be due to the receipt of the supporting documents. I also efiled my EB1-EA application, then sent supporting evidence by express mail. On the day of the receipt I noticed LUD change, but it did not explicitly mention the receipt of supporting documents.

Hi Kumarbr2000,

Thanks for your reply. So after your LUD, has your online text changed? Mine is still the same old message "On Dec. ...., we received this I140 immigration petition for alien worker, and mailed you a notice describing how we will process your case ....". From some previous postings, I did get the impression that after the UCSIC receive the supporting documents, they will post this information in the message.

Did your e-filed case also go to TSC?

Thanks!

Yes, it went to TSC

Hi Kumar,

within how many days one should send the supporting documents (after efiling). do we need to write briefly about the cause for denial since my initial petition was turned down at NSC couple of days before. Any comments please?. there is a column in I-140 form whether the petition was filed earlier and the outcome.

Madgu you can re-file righ away as long as you address the cause of denial, the best thing you can do is that you didnt have enough time to get the Extra evidence and when you repilied the RFE it was incomplete or soemthing like that..

Today i Talk to my lawyer, she told me NSC is not approving anything at all. We discuss and we might withdraw your case from NSC and file in TSC. Still taking about it her.

How does your lawyer know that NSC is not approving anything? We have seen a few approvals in this forum. If NSC does not want to approve then why are they issuing RFEs. nothing makes sense.

She said everyone in AILA is talking about it, they keep sending RFE for no reason and now everyone is trying to avoid filling NSC. I am sure they are approving but is minimal, my RFE respone is done, we might send or not, we have to decied this weekend.

She is double checking eveyrthing.Whyis NSC so hard!

Hey guys,

I am actually not really sure why not to try EB2-NIW instead of EB1-EA? Since NIW is considered easier, and it is both not employer-sponsored and has the same advantages?

I get the feeling that many people on this forum consider EB2-NIW not as good of an approach as EB1-EA. If you are in the medical sciences why not go for EB2-NIW right away?

Also, if you efile to TSC, and then submit your supporting documents a couple of days later, do you wait until you get the confirmation that your efiled material went to TSC before sending the supporting documents so that you make sure that it did not end up in NSC?
Is it correct that efiling means that you cannot do PP?

Thanks!

hi tipotodo,
are you planning to withdraw, and then e file to TSC, but you have to submit all these documents from the scratch, am I right?
I saw a message change yesterday and today another update, so far we have not received any fax or email of approval. still waiting and ---------.
Hope something good will happen.
