support filing

My wife is a USC, and I will be supporting the family financially. What form do I need to fill out to file the petition? Do I need to request the tax thing? does she have to request the tax too?

Basically, what things should I do?

Your spouse would file form I-864, listing your income on the form in question 24. Include a job letter from your employer, and your Federal tax transcripts. If her income is not being used to meet the income requirements, she doesn't need to provide her tax transcripts. See the I-864 instructions for details.

I looked at the form, part 1 question number 1, there's no option for me but rather my wife who is USC... which one should I pick?

yes you and your wife have to fill the form I-864A one for the petitioner(US citizen) and one for the sponsor's.

Your wife is to fill out the I-864, and choose (a) for part 1 question 1. Part 6, question 24 is where you can list your income.

I-864A is not necessary if the immigrant is the spouse of the petitioner. The instructions say that.

Jack, i looked and looked again but it doesn't say anywhere on the I864 instruction about the immigrant not having to fill out the I864A. Could you point me to that section? I have read it but not see it anywhere.

Jack, I think I found it:

If you included the income of the intending immigrant whois your spouse (he or she would be counted on line 21a),evidence that his/her income will continue from the currentsource after obtaining lawful permanent resident status mustbe provided. He/she does not need to complete FormI-864A unless he/she has accompanying children.

Now my question is about this question:
I am sponsoring the principal immigrant named in Part 2 above.
9.
I am sponsoring the following family members immigrating at the same time or within six months of the principalimmigrant named in Part 2 above. Do not include any relative listed on a separate visa petition.
Yes
No (Applicable only in cases with two joint sponsors)

My wife has a job but technically I am sponsoring her financially, meaning her income doesn't meet requirement.. how should we answer this?

She is sponsoring you for immigration purposes, and she must fill out the I-864, not you. Anywhere that it says "I am sponsoring...", they are referring to the USC who is sponsoring the immigration aspect of the process, not necessarily the financial.

So she should check "X" I am sponsoring the principal immigrants.... and checked "Yes"?

Also, you said she doesn't need to request the federal tax transcript? My federal tax is enough? But it asks on that I864 form about her tax too.

Correct.

If she is not using her income to meet the support requirements, she does not need to include her own tax transcripts. But if she puts her income there she needs to attach her transcript (or a joint transcript if you filed jointly).

But it asks on that I864 form about her tax too.
That is because the normal expectation is that the USC sponsor will be using their own income towards the requirements. It is not applicable if the support income is all coming from the intending immigrant or a co-sponsor.

Correct.

She has the job and we have joint checking that we use to support each other. I guess, even she doesn't meet the requirement, she can still say she's sponsoring but with the help of my income together. That means we both have to show the tax transcript, right?

I have another question on the form. Part 5:

Persons you are sponsoring:
a Enter the number you entered in line 10 - 1 (me/intending immigrant)

Then Persons not sponsored in this affidavit:
c. If you are currently married, enter "1"

if she puts 1 there, it will make 3 in household. The question seems to be redundant. What is our option?

If her income is expected to continue after your GC is granted and she wants to list it even though your income alone is sufficient, she can list her own income, which means she would have to provide her own tax transcript in addition to yours.

You the immigrant spouse are being sponsored, so you are not to be included in the "persons not being sponsored" section.

Is there a section that she can say "use my husband income" :) ? I am little bit confused here. Or you are saying, at her income section, just put 0 so then it will use my income?
