Suing the previous employer after receiving the Green Card

Hello All,

I really like to get an answer ASAP. I am suing my previous employer who sponsored my green card to get some pending wages worth about $4000. I quit the job with the previous employer last Friday(April 12,2002). I had been with that company for about 5 1/2 years. I got my plastic card in the mail last week. I am still waiting for my wife\'s card.

Is it possible for my previous employer to cancel my Green Card to retaliate against the law suit? I really appreciate your advice. Thanks.

They don\'t have the right to cancel your GC. They can only
complain to the INS that you commited a fraud by pretending
the intent to work for them indefinitely after getting the
GC and then leave up to teh INS to decide. So if you have
the clear and convincing evidence that you did have teh intent
to work for them at teh time getting yoru green card,
then you don\'t have to worry. But I believe that all such evidence
(from both sides) are circumstancial so that a decision is lways a judgement call.

$4000 is pre-tax money I assume. So you are talking about
may be $ 2400 here.
 
You are so fuxx stupid. I am sorry for your company. They are blind to support your GC.

It is a standard of burden of proof between "a predondence of the evidence" and "beyond all reasonable doubt". They are all
subjective and no way to define.
 
Probably a bad idea!

If you are just suing them for money, you\'ll only end up spending it on lawyer\'s fees. And think of the valuable time you have to waste suing them.
Is it worth it?.
It would make sense if you are suing for 100K+.

worked in my case, I am not sure how it will work for you

My first employer here refused to pay giving some silly reason. I called the Federal Min Wages Labor dept office in Masachussets. I dont know what they did but I got the check in a week. Make sure you have time sheets or work records to support your claim and that you did not create any kind of problem for the client or your employer.

Worth a try since you have nothing to loose if you are legally entitled to get the money.
